1. Acceptance

Accessing and using the website elyashapewear.fr (hereinafter "the Site") implies full and unreserved acceptance of these Terms of Use. Any person who does not accept these Terms of Use is asked to leave the Site.

2. Access to the Site

The Site is accessible 24 hours a day, 7 days a week, subject to any interruptions for maintenance, updates, or force majeure. Elya cannot be held liable for any interruptions, malfunctions, or data loss that may result therefrom.

3. Customer Account

Creating a customer account is reserved for natural persons of legal age (18 years or older). The customer is solely responsible for keeping their login credentials confidential. Any connection or order made from their account shall be deemed to have been made by the account holder.

In the event of suspected fraudulent use, the customer must immediately notify Elya. Elya reserves the right to suspend or delete any account displaying suspicious behaviour or behaviour contrary to these Terms of Use.

4. Intellectual Property

All content on the Site (texts, images, logo, graphics, structure, source code, product descriptions) is the exclusive property of Elya or its partners and is protected by copyright, trademark law, and database rights. Any reproduction, representation, modification, distribution, or exploitation, whether total or partial, without Elya's prior written authorisation, is strictly prohibited and constitutes infringement punishable under Articles L.335-2 et seq. of the French Intellectual Property Code.

5. Use of Customer Reviews

By posting a review on the Site, the customer grants Elya a non-exclusive, free, worldwide, and perpetual licence to use, reproduce, and adapt that review for commercial and marketing purposes. Elya reserves the right to moderate, remove, or refuse to publish any review that does not comply with the law, public decency, or that is deemed inappropriate.

6. Limitation of Liability

Elya cannot be held liable for:

Indirect, immaterial, or unforeseeable damages
Malfunctions related to the customer's internet connection
The content of third-party sites linked to the Site
The consequences of using the products in a manner inconsistent with their intended purpose

In any event, Elya's liability is limited to the amount of the order concerned.
