Article 1 — Preamble and Identification of the Seller
These Terms and Conditions of Sale govern the contractual relationship between:

hereinafter "the Seller", and any non-trading natural person of legal age making a purchase on elyashapewear.fr, hereinafter "the Customer". Any order implies full, complete, and unreserved acceptance of these Terms and Conditions of Sale.
Article 2 — Products
The products offered are described with the utmost accuracy. The photographs illustrating the products are provided as examples and are not strictly contractual (variations from one screen to another are possible). Products are available while stocks last. In the event of unavailability after an order is placed, the Seller will inform the Customer and will make a full refund within 14 days.
Article 3 — Order and Formation of the Contract
The Customer places an order directly on the Site. Confirmation of the order, following acceptance of the Terms and Conditions of Sale, constitutes firm and final acceptance. The contract is formed upon payment confirmation, evidenced by the sending of a confirmation email.
Article 4 — Prices
Prices are shown in euros (€), exclusive of VAT. The Seller benefits from the basic VAT exemption scheme (Article 293 B of the French General Tax Code) in its capacity as a micro-entrepreneur: VAT is neither applicable nor charged on the displayed sale prices.
- France, Belgium, Luxembourg: net prices, standard delivery free of charge (see Shipping Policy)
- Switzerland: net prices, excluding Swiss VAT of 8.1%, which will be collected by Swiss customs upon importation, together with any customs and clearance fees. These amounts are the sole responsibility of the Customer.
Delivery charges are added and are indicated before the order is confirmed. The Seller reserves the right to change its prices at any time; products will be invoiced on the basis of the rates in force at the time the order is confirmed.
Article 5 — Payment
Payment is due in full immediately upon ordering. Accepted payment methods: bank card (Visa, Mastercard, American Express), Apple Pay, Google Pay. Transactions are secured by Shopify Payments (Stripe). No banking details are retained by Elya.
In the event of non-payment, late payment, or default, Elya reserves the right to cancel the order by operation of law, without notice or compensation to the Customer.

Article 7 — Right of Withdrawal
In accordance with European Directive 2011/83/EU and Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal.
The terms and conditions for exercising this right are detailed in our Returns and Refund Policy, which forms an integral part of these Terms and Conditions of Sale.
Return shipping costs are borne by the Customer. In addition, in accordance with Article L.221-23 of the French Consumer Code, a proportional deduction may be applied to the refund in the event of depreciation of the product (signs of use beyond a normal trial, damaged original packaging or parcel), under the conditions specified in the said policy.
Article 8 — Legal Guarantees
All products benefit from:
- The legal guarantee of conformity of 2 years (Articles L.217-3 et seq. of the French Consumer Code)
- The warranty against hidden defects of 2 years from the discovery of the defect (Articles 1641 et seq. of the French Civil Code)
To invoke a guarantee, the Customer must contact customer service by email with detailed photos and proof of purchase. Any undocumented request will be returned for further information.
Article 9 — Liability of the Seller
The Seller's liability is limited to the amount of the order concerned. The Seller cannot be held liable for indirect, immaterial, or unforeseeable damages, nor for the consequences of using the products in a manner inconsistent with their intended purpose or with the care instructions provided.
Article 10 — Force Majeure
The Seller cannot be held liable for the non-performance or delayed performance of the contract in the event of force majeure: strike, industrial disputes, exceptional weather conditions, pandemic, disruption of postal services, major IT failure, or any event beyond its reasonable control.
